The New NJEDA Reporting Regulations: What You Need to Know

The New Jersey Economic Development Authority (NJEDA) has implemented new reporting regulations under N.J.A.C. 19:31-18.11 that significantly change the annual compliance obligations for companies receiving Grow New Jersey tax credits. These changes are effective for reporting periods ending Dec. 31, 2025, with annual submissions due April 30, 2026.

New Reporting Rules for Grow New Jersey Recipients

Previously, companies fulfilled their yearly reporting obligations through internally prepared, management-certified reports. The revised rule shifts from self-certification to enhanced third-party verification to strengthen oversight and accountability for maintaining compliance with program objectives. The annual report should include detailed information on full-time employees at the qualified facility, statewide workforce totals, affiliate data contributing to employment counts, and compliance certifications with incentive agreements and program requirements.

The most significant change is the requirement for a CPA-issued AUP report. The CPA will perform and report on specific procedures accepted by the NJEDA. Results are delivered via an agreed-upon procedure, and a report is provided to help evaluate and maintain program compliance.
